The highest court maintained the government’s decision to suspend Article 370 and ordered that the parliament hold elections by September 30 of the following year. The SC also affirmed Ladakh’s reorganisation as a Union Territory.

Judge Chandrachud stated that Article 370, which was repealed on August 5, 2019, was a temporary solution brought about by the war-torn conditions in the former state.

Judges Sanjay Kishan Kaul, Sanjiv Khanna, BR Gavai, Surya Kant, and Chief Justice of India DY Chandrachud made up the five-judge constitution bench that rendered the decision. After hearing the arguments for sixteen days, the supreme court reserved its decision on September 5.

Mehbooba Mufti, the leader of the People’s Democratic Party (PDP), stated on Monday that the Supreme Court’s ruling upholding the abrogation of Article 370 is “nothing less than a death sentence” and that it signifies the defeat of the concept of India that the state with a majority of Muslims had acceded to in 1947.

“Today, an illegal and unconstitutional conduct that occurred in the Parliament was made lawful. “It is essentially a death sentence, not only for the idea of India but also for Jammu and Kashmir,” Mehbooba Mufti declared in a five-minute video message that she uploaded to X.

Article 370 was eliminated because the Supreme Court declared it to be provisional. Not only have we lost, but the concept of India has also failed. “My sincere advice to a section of people in Jammu and Kashmir who will not be happy with this judgement is that they should accept the fact that now that this has been done and the Supreme Court has upheld the action and therefore there’s no point now unnecessarily hitting their head against the wall,” said Karan Singh, a Congress leader and the son of Hari Singh, the former Maharaja of Jammu and Kashmir.

“I now advise them to focus their efforts on contesting the upcoming elections. That’s where people ought to be now, he remarked, rather than being pessimistic.

“I am disappointed by the Supreme Court’s decision over Article 370. Justice escapes the people of Jammu and Kashmir once more.
